You may use the Avaro website for lawful purposes only.

You must not:

  • Use our website for fraudulent or unlawful purposes.

  • Attempt to gain unauthorised access to our website or systems.

  • Interfere with the operation, security or functionality of our website.

  • Use automated systems to access or collect information from our website without our prior written permission.

We reserve the right to restrict or suspend access to our website where we reasonably believe these Terms & Conditions have been breached.

3. Product Information

We make reasonable efforts to ensure that product descriptions, images, specifications, dimensions and other information displayed on our website are accurate and up to date.

However, products may vary slightly from images shown on the website, particularly in relation to colour, finish, packaging and minor design details.

Manufacturers and suppliers may also update product specifications from time to time.

Where appropriate, the manufacturer's current specification will take precedence.

Nothing in these Terms & Conditions affects your statutory rights.

4. Product Suitability

Customers are responsible for ensuring that products are suitable for their intended use, available space and requirements.

Where you are unsure whether a product is suitable, we recommend contacting Avaro before placing your order.

Where information is provided by Avaro regarding a product, such information is intended as general guidance and does not replace the manufacturer's instructions or specialist professional advice where such advice is required.

5. Prices

All prices displayed on our website are in pounds sterling (£).

Where applicable, VAT will be included in the displayed price or clearly identified before you complete your purchase.

Delivery charges, where applicable, will be displayed before you complete your order.

We reserve the right to correct genuine pricing or information errors.

If an obvious pricing error occurs and you place an order at an incorrect price, we will contact you before processing the order and give you the option to proceed at the correct price or cancel the order.

6. Placing an Order

When you place an order through our website, you are making an offer to purchase the products selected.

Your order is not necessarily accepted immediately.

We may contact you to confirm product availability, delivery requirements or other information before accepting your order.

Once your order has been accepted, we will provide confirmation by email.

We reserve the right to refuse or cancel an order where there is a genuine reason to do so, including:

  • The product is unavailable.

  • There has been an obvious pricing or product information error.

  • We are unable to deliver to the requested location.

  • We reasonably suspect fraudulent activity.

  • A supplier is unable to fulfil the order.

If we cancel an order after payment has been taken, we will provide an appropriate refund.

7. Product Availability

Avaro works with a number of manufacturers and suppliers, and product availability can change.

Some products may be supplied directly by manufacturers or distribution partners.

If a product becomes unavailable after you have placed an order, we will contact you where appropriate and discuss the available options.

These may include:

  • Waiting for the product to become available.

  • Selecting an alternative product.

  • Agreeing a revised delivery arrangement.

  • Cancelling the order and receiving a refund.

8. Payment

Payment must be made using one of the payment methods available through our website.

You must ensure that the payment information you provide is accurate and that you are authorised to use the relevant payment method.

Orders will normally only be processed once payment has been successfully authorised or received, unless alternative payment terms have been agreed with Avaro in writing.

9. Delivery

We aim to provide estimated delivery information at the time of purchase.

Delivery times may vary depending on:

  • Product availability.

  • Manufacturer or supplier lead times.

  • Delivery location.

  • Product size and weight.

  • Specialist delivery requirements.

  • Carrier availability.

We will make reasonable efforts to meet any stated delivery estimate.

Where a significant delay occurs, we will contact you where appropriate.

For consumer orders, goods will generally be delivered within 30 days unless a different delivery period has been agreed with you.

10. Large or Specialist Equipment

Some fitness equipment is large, heavy or requires specialist transportation.

Additional delivery requirements or charges may apply to certain products.

Where this is the case, the relevant delivery arrangements will be communicated before or during the ordering process.

Customers are responsible for ensuring that there is suitable access to the delivery address, including sufficient doorways, corridors, stairways, lifts and other access points.

Where specialist delivery or access arrangements are required, customers should contact Avaro before ordering.

11. Delivery Inspection

We recommend inspecting your delivery as soon as reasonably possible.

If the packaging or equipment appears damaged, please contact us promptly and provide photographs where appropriate.

You should retain the original packaging where possible until you are satisfied that the product has arrived safely and is functioning correctly.

Failure to report damage immediately does not remove any statutory rights you may have.

12. Cancellation & Returns

If you purchase products from Avaro as a consumer online, you will generally have a legal right to cancel your order within 14 days of receiving the goods, subject to applicable exceptions.

You do not normally need to provide a reason for cancelling during this statutory cancellation period.

After notifying us of your cancellation, you will generally have a further 14 days to return the goods.

Further information regarding the cancellation process, returns and refunds is provided in our Returns & Refunds Policy.

Certain products may be excluded from statutory cancellation rights, including certain goods made to a customer's specifications or clearly personalised goods.

Nothing in these Terms & Conditions limits your statutory rights.

13. Refunds

Where you have a legal right to cancel an online order, refunds will be processed in accordance with applicable law.

Where applicable, the refund will include the cost of standard delivery.

If you selected a more expensive delivery option, we may only be required to refund the equivalent of the standard delivery charge.

Refunds will generally be made using the original payment method.

Where goods are returned, we may be able to make a deduction where their value has been reduced as a result of handling beyond what would reasonably be necessary to establish their nature, characteristics and functionality.

14. Faulty, Damaged or Incorrect Products

If your product arrives faulty, damaged or not as described, please contact us as soon as reasonably possible.

We will assess the issue and provide an appropriate remedy in accordance with applicable law.

Consumer goods must meet statutory requirements, including being:

  • As described.

  • Of satisfactory quality.

  • Fit for purpose.

These rights cannot be excluded by our Terms & Conditions.

15. Warranties

Certain products may be covered by a manufacturer's warranty.

Where applicable, warranty information will be provided with the product or within the relevant product documentation.

A manufacturer's warranty is additional to your statutory rights and does not replace them.

16. Assembly & Installation

Unless specifically stated otherwise, fitness equipment may require customer assembly.

Customers are responsible for following the manufacturer's assembly and installation instructions.

Where professional installation is recommended, customers should use an appropriately qualified or experienced installer.

Customers should not modify equipment unless permitted by the manufacturer.

Avaro cannot accept responsibility for damage caused by incorrect assembly, installation, modification or misuse, subject to any statutory rights that apply.

17. Safe Use of Fitness Equipment

Fitness equipment should always be used in accordance with the manufacturer's instructions and safety guidance.

Customers are responsible for ensuring that equipment is used appropriately.

Where equipment requires anchoring, specialist flooring, electrical connections or other installation requirements, customers are responsible for ensuring that these requirements are properly addressed unless Avaro has expressly agreed otherwise in writing.

Commercial customers are responsible for ensuring that appropriate risk assessments, inspection, maintenance and user procedures are in place where required.

18. Commercial & Trade Customers

Avaro welcomes enquiries from commercial and trade customers.

This may include:

  • Commercial gyms.

  • Hotels.

  • Sports clubs.

  • Schools and educational facilities.

  • Personal training studios.

  • Property developers.

  • Leisure facilities.

  • Strength and conditioning facilities.

  • Other businesses and organisations.

Large or commercial orders may be subject to specific quotations, payment terms, delivery arrangements and project-specific conditions.

Where specific written terms have been agreed with a business customer, those terms will take precedence over these Terms & Conditions where there is an inconsistency.

19. Intellectual Property

All content displayed on the Avaro website, including our branding, logo, photographs, graphics, written content, designs and other materials, is owned by or licensed to Avaro unless otherwise stated.

You must not reproduce, modify, distribute or commercially exploit our intellectual property without our prior written permission.

20. Third-Party Websites

Our website may contain links to third-party websites, manufacturers or other services.

These websites are operated independently from Avaro.

We are not responsible for the content, availability, security or privacy practices of third-party websites.

You should review the relevant third party's terms and policies before using their services.

21. Website Availability

We aim to keep our website available and functioning correctly.

However, we do not guarantee that the website will always be available, uninterrupted or error-free.

We may temporarily suspend access to the website for maintenance, security updates, improvements or other operational reasons.

22. Limitation of Liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, faulty goods or any other liability which cannot legally be excluded or limited.

For consumers, nothing in these Terms & Conditions affects your statutory rights.

We will not be responsible for losses caused by circumstances outside our reasonable control, subject to applicable law.

23. Events Outside Our Reasonable Control

We will not be responsible for delays or failure to perform our obligations where this is caused by circumstances beyond our reasonable control.

These circumstances may include:

  • Severe weather.

  • Natural disasters.

  • Transport disruption.

  • Supplier disruption.

  • Industrial disputes.

  • Government restrictions.

  • Telecommunications or infrastructure failures.

  • Other circumstances outside our reasonable control.

Where reasonably possible, we will notify affected customers and take appropriate steps to minimise disruption.

24. Privacy

We collect and process personal information in accordance with our Privacy Policy.

Our Privacy Policy explains how we collect, use, store and protect personal information.

25. Complaints

We want our customers to have a positive experience with Avaro.

If you have a complaint regarding a product, order, delivery or service, please contact us first so that we can investigate the matter and attempt to resolve it.

Please provide your order number and as much information as possible about the issue.

We aim to deal with complaints fairly and promptly.

26. Changes to These Terms

We may update these Terms & Conditions from time to time.

The version applicable to your order will generally be the version in force when your contract with us is formed, unless a change is required by law or otherwise agreed with you.

The latest version will be available on the Avaro website.

27. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

If you are a consumer, you will also benefit from any mandatory protections provided by the laws applicable to you.

Any dispute will be subject to the jurisdiction of the courts applicable under the relevant laws.
